Housing Element Update

UPDATE 

7/16/25 - On September 23, 2024, the City Council approved the City's revised 6th Cycle Housing Element. On October 17, 2024, the Local Coastal Program (LCP) amendments (Ordinance 523 and Resolution No. 24-49) were transmitted to the California Coastal Commission (CCC) for its certification review. On October 18, 2024, an executed copy of Ordinance 523 approving the Malibu Municipal Code (MMC) and Local Coastal Program (LCP) amendments was submitted to the California Housing and Community Development HCD along with proof that the LCP amendments were submitted to the CCC. On December 3, 2024 the Housing Element was certified by California Housing and Community Development (HCD).

What is a Housing Element?

State Housing Element law requires that each City and County identify and analyze existing and projected housing needs within their jurisdictions, and prepare goals, policies, programs, and quantified objectives to further the development, improvement, and preservation of housing. 

The four major and required components of the Housing Element are the following:

  • Housing Needs Assessment: An analysis of the City's demographic, household and housing characteristics and related housing needs.
  • Housing Constraints: A review of potential market, governmental, and infrastructure constraints to meeting the City's identified housing needs.
  • Housing Resources: An evaluation of residential sites and financial resources available to address the City's housing goals.
  • The Housing Plan: A plan for addressing the City's identified housing needs, constraints, and resources through housing goals, policies and programs.

Submittals to HCD & DRAFTs

On December 3, 2024 the Housing Element was certified by HCD.

On October 4, 2024, the City submitted its revised 6th Cycle Housing Element to HCD for review. 

On September 27, 2024, the City published the 2021-2029 Housing Element for a 7-day public review period, through October 3, 2024.

In September 2024, the City published a revised draft of the Housing Element for the September 23, 2024 City Council public hearing. 

On July 31, 2024, HCD submitted a letter to the City stating that the July 29 draft housing element meets state requirements.

On July 29, 2024, the City submitted its 7th version of the 2021-2029 Housing Element to the HCD for review. 

On July 19, 2024, the City published a 6th version of the 2021-2029 Housing Element for a 7-day public review period, through July 26, 2024.

On June 21, 2024, HCD submitted a comment letter to the City in response to its most recent submittal.

On May 7, 2024, the City submitted its 5th version of the 2021-2029 Housing Element to the HCD for review. 

On April 29, 2024, the City published an updated Revised 2021-2029 Housing Element to the public for a 7-day public comment period. 

On March 22, 2024, the HCD submitted a letter to the City in response to its most recent submittal. Please note that no changes were made to the March 13, 2024 submittal and this version is referred to as "revisions received March 21, 2024." 

HCD provided a preliminary review of the City's February 2024. In response, the City has updated the Revised Housing Element. Updates to the Housing Element are highlighted in blue. This version has been submitted to HCD. 

On February 7, 2024, the City submitted the 2021-2029 Housing Element to HCD for its consideration. 

On July 20, 2023, the City of Malibu received a "Failure to Adopt Compliant 6th Housing Element - Letter of Inquiry."

On June 7, 2023, the City of Malibu issued a letter to HCD in response to the May 19, 2023 letter which provided a timeline for the City's adoption of an updated Housing Element addressing HCD's 2022 comment letter. 

On May 19, 2023, the City of Malibu received a "Failure to Adopt Compliant 6th Housing Element - Letter of Inquiry."

On March 22, 2022, the HCD issued a letter finding that the Revised Draft 2021-2029 Housing Element Update addresses many statutory requirements; however, revisions will be necessary to comply with State Housing Element Law. 

On January 10, 2022, the City Council adopted the Revised Draft  2021-2029 Housing Element Update. After adoption, the revised draft will be submitted to HCD for a second round of review and certification. 

On October 22, 2021, the HCD issued a letter finding that the draft element addresses many statutory requirements; however, revisions will be necessary to comply with State Housing Element Law. 

Following the City Council meeting, feedback was incorporated into the draft Housing Element which was then sent to the California Department of Housing and Community Development (HCD) for review on August 24, 2021.
