Step 3: Civil Appeal

California Vehicle Code Section 40230(a) allows for the ability to file a Civil Appeal with the Los Angeles County Superior Court ("Court") for a parking citation if you are dissatisfied with the results of your Administrative Hearing. To proceed with this level, you must request a civil appeal with the Court within 30 days of the date of the mailing of the Parking Citation Administrative Hearing decision.

NOTE: You may not request a Civil Appeal unless you have received a Result of Administrative Hearing and have been found liable.

How to Request a Civil Appeal

After receiving the Result of Administrative Hearing from the Hearing Officer in the mail, the individual contesting the decision ("Contestant") must file a Notice of Appeal - Parking and a copy of the Administrative Hearing Notice of Decision with the Court. The hearing decision is submitted as evidence for the Court appeal.

NOTE: If the citation remains unpaid due to a previous request for a waiver of the penalty, you must pay your citation in full to the City prior to filing a Civil Appeal,

The Notice of Appeal - Parking is available at the Court. The Appeal must be filed in person within 30 days after personal delivery or within 35 days after mailing (CCP 1013) of the Hearing Officer's decision to the Contestant. The Contestant must pay a $25 filing fee for each parking ticket that is being appealed to the Court. The Court will notify the Contestant of the date, time, and location of the hearing by mail or in person.

The Contestant cannot file an appeal unless the Administrative Hearing process has been completed and a Notice of Decision on the Administrative Hearing is received by the Contestant and filed with the Notice of Appeal - Parking.

The Contestant shall serve a copy of the Notice of Appeal - Parking to the City of Malibu ("City") by delivering it in person or sending it via first class mail 20 days prior to the hearing date. The Proof of Service of Notice is available at the Court. The Contestant shall complete and file the Proof of Service with the County Clerk’s Office not later than 10 days prior to the hearing date.

At the Hearing

The judicial officer shall hear the case de novo (anew, or as for the first time) and the City’s file shall be received into evidence and the notice of parking violation shall be admitted as evidence of the facts stated therein.

After the Hearing

The Contestant and the City shall be provided with the judicial officer’s Notice of Decision - Parking Appeal either at the conclusion of the hearing or by mail. If the Court finds the Contestant not liable, the appeal filing fee, together with any deposit of parking penalty, will be refunded by the City in accordance with the Court’s judgment.

IMPORTANT: The Court’s decision on the parking appeal is final and not appealable.
